By participating in the Program, you agree to accept all versions of the Program Terms and Conditions and acknowledge that you have read, understand, and consent to the Privacy Policy.

The Loyalty Program is exclusively offered by Ebony Blossom. Members participating in the Program agree to be bound by these Terms and Conditions, which may change from time to time.

These Terms and Conditions supersede all previous terms and conditions applicable to the Program. All Program benefits, offers, rewards, and services are subject to availability. EBONY BLOSSOM reserves the right to amend, modify, supplement, or terminate the Program, the Terms and Conditions, the structure for earning rewards, or reward levels. Such changes may affect the value of rewards or the ability to obtain certain rewards. If notice of such action is required by law, it will be provided accordingly. In the event of Program termination, all unredeemed benefits will be forEbony Blossomted without obligation or liability and will not be honored upon termination or after the conclusion of any required notice period. Ebony Blossom's decisions on Program administration are final. Ebony Blossom is not liable for delays or failures due to acts of nature or circumstances beyond reasonable control.

Ebony Blossom reserves the right to cancel or suspend your Program participation in cases of fraud, abuse of rewards privileges, violation of Program Rules or applicable laws, or at our discretion. Rewards points in your account will become void upon cancellation. Points obtained through error, fraud, deception, or unauthorized means may be revoked.

Members are responsible for understanding and remaining informed about Program Rules, changes, benefits, rewards, the Ebony Blossom Privacy Policy, and communications from Ebony Blossom to understand your rights and status. For inquiries about the Program or these Rules, contact Customer Service.

Members are accountable for any tax liability related to Program participation.

ELIGIBILITY & ENROLLMENT

This Program stands as a distinct and separate initiative from Ebony Blossom.

• Rewards granted through this Program and those obtained from any other program offered by Ebony Blossom, or its participating partners cannot be interchanged, transferred, or combined unless otherwise specified herein.
• Your mobile phone number serves as your unique membership identifier and is necessary to earn points on eligible purchases. As we utilize your mobile number and email address to identify you as a member and notify you of Program benefits, it's essential that both details are accurate and up-to-date.
• Corporations, groups, and associations are not eligible to take part in the Program.
• Individuals may join the Program by furnishing accurate information on the Ebony Blossom website or other available channel(s).
• Ebony Blossom reserves the right to decline membership in the Program at its sole discretion, without prior written notice.
• Program benefits and rewards are non-transferable unless explicitly stated otherwise. Any attempts to transfer or assign such rewards will be deemed null and void.
• In the event of a member's passing, their account will be closed, and any benefits or rewards within the account will be forEbony Blossomted.

BENEFITS OF MEMBERSHIP

Membership comes with exclusive rewards, including points, services, and access to events. Since we communicate Program updates, account details, benefits, and promotions through email, it's crucial to ensure that your email address is up-to-date. Ebony Blossom cannot be held responsible for communications, offers, or rewards sent to outdated email addresses.

Earn Points

To earn points while shopping, ensure you identify yourself as a member by providing your member mobile number during checkout.

Base Points

As outlined, your tier status and membership category determine the specific number of points you receive for each dollar (USD $1/-) of qualifying net spend. Certain products and services might be excluded from this benefit. Exclusions apply, and some products may have limited or excluded promotional bonus points opportunities. Notification of bonus point promotions will be sent via email.

Points Calculations

Points are calculated for eligible purchases based on the net purchase amount, rounded to the nearest USD. The net purchase amount is the spend amount after returns, discounts, taxes, shipping, and any amounts redeemed in Gift Cards or points have been deducted. Points awarded for returned items will be deducted from your points balance.

Points won't be earned on charitable donations and purchases of certain brands. Additional exclusions may apply for special promotions or offers, disclosed within their terms.

Expiration

Points will expire if a Program account remains inactive for twelve (12) consecutive months.

IMPORTANT NOTE

Points hold no cash value and cannot be converted to cash or credit. You possess no ownership interest in points, and collected rewards are not considered property.

The term "earn" or similar language in marketing materials regarding the Program does not imply any value for points before conversion or redemption.

Points cannot be bought, sold, or transferred unless stated otherwise herein.

Program benefits are tier-based. Some benefits might apply only to specific products.

Tier status benefits must be used in the year they're awarded; unused benefits will expire at the end of each calendar year.

At the start of each calendar year, benefits will be renewed based on the previous year's achieved status level. If a member advances to a higher tier during the year, they're entitled to benefits for the achieved new status. If any part of a benefit was used at a lower status, it'll be deducted from the total allocation in the new status.

SEVERABILITY

If any provision of these Program Rules or the application of any such provision to any person or circumstance is deemed invalid, illegal, or unenforceable for any reason, it shall not impact the validity or enforceability of the remaining provisions of these Program Rules. The application of such provisions to other individuals or situations shall remain unaffected. If a court determines a provision to be invalid, illegal, or unenforceable, the court shall modify and interpret the provision to make it valid and enforceable against all parties within the limits of legality and enforceability, providing maximum protection to indemnified parties.

NO WAIVER

Ebony Blossom's failure to insist upon strict compliance with any provision of these Program Rules does not imply a waiver of that provision or right. It also does not preclude us from enforcing such provisions or rights in the future. These Program Rules do not restrict Ebony Blossom from exercising any legal rights or remedies it possesses.

HEADINGS

The headings within these Program Rules are solely for reference convenience. They shall not affect the interpretation or construction of any of the provisions contained herein.

COMPLETE UNDERSTANDING

These Program Rules, along with the referenced Privacy Policy, constitute the complete understanding between you and Ebony Blossom concerning the Program.

ERRORS OR INCONSISTENCIES

Despite our utmost efforts to ensure accuracy, occasional errors may arise. We retain the right to rectify such errors at any time, even if they affect pending benefits, rewards, or points in your account. In case of any inconsistency or discrepancy between the Program Rules, related materials, or advertising statements, the terms of the current Program Rules shall prevail, govern, and control.

LIMITATIONS OF LIABILITY & DAMAGES

Except as expressly provided otherwise, the Program and all associated products and services are provided on an "as is" basis. Ebony Blossom disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Additionally, Ebony Blossom does not guarantee uninterrupted or error-free operation of the Program.

Participation in the Program is undertaken at your own risk. Neither Ebony Blossom nor its affiliated or related entities, vendors, or content providers shall be held liable for any direct or indirect loss, damage (including actual, consequential, punitive, special, or otherwise), injury, claim, or liability arising from or connected to your participation in or inability to participate in the Program.

You agree to indemnify, defend, and hold harmless Ebony Blossom, its shareholders, officers, directors, employees, agents, distributors, vendors, and affiliates from any and all third-party claims, demands, liabilities, costs, or expenses, including reasonable attorney's fees, resulting from your breach of these Program Rules.

If any part of these warranty disclaimers or limitations of liability is found to be invalid or unenforceable, or if Ebony Blossom is found to be liable to you in any manner, our aggregate liability for all claims under such circumstances shall not exceed the amount paid by you for your Program participation over the previous twelve (12) months. Some jurisdictions may not permit the exclusion of certain warranties or the limitation or exclusion of liability for damages. Consequently, some of the above indemnities, limitations, and disclaimers may not apply to you. If applicable law prohibits us from disclaiming warranties or limiting liability, our warranties and liability will be limited to the minimum extent required by law.

We reserve the authority to transfer our rights and responsibilities as outlined in these Program Rules, including via mergers, acquisitions, asset or equity sales, or due to legal requirements. These Program Rules are governed by the laws of the United States, without consideration of conflict of law principles. Any legal proceedings related to the Program or interactions with Ebony Blossom must be initiated in the state of Delaware, USA. By participating, you agree to the jurisdiction of these courts for such matters.
